The licence you get

Every download from the 3DVista Marketplace arrives with a licence.txt beside the panoramas. This is that file, published here so you can read it before you buy rather than after. My360Place is the licensor, so these terms are the ones that govern your copy.

The short version

• Royalty free. A royalty-free, non-exclusive licence to possess and use the files. Nothing further is ever owed, however well the thing you build does.
• Commercial work is fine. Unlimited copies and back-ups, for your own business and personal use.
• You can build them into your own product. Not only into a 3DVista tour: a Unity or Unreal scene, a Pano2VR or ThingLink tour, a game, a training course.
• Perpetual. The licence does not expire.
• What you cannot do: sell the files themselves, or put them in a product whose value comes from the files being in it. The panoramas are the backdrop to what you make, never the thing you resell.
• Also not allowed: reverse engineering, decompiling or disassembling, except where the law says otherwise.

End user licence agreement, in full

END USER LICENSE AGREEMENT

This End-User License Agreement (this “EULA”) is a legal agreement between you (the buyer) (“Licensee”) and My360Place (Licensor), the author of AI-generated 360° images, including all HTML files, XML files, graphics files, animation files, data files, technology, both in object code and source code (the “files”), and the deliverables provided pursuant to this EULA, which may include associated media, printed materials, and “online” or electronic documentation.

By installing, copying, or otherwise using the files, Licensee agrees to be bound by the terms and conditions set forth in this EULA. If Licensee does not agree to the terms and conditions set forth in this EULA, then Licensee may not download, install, or use the files.

1. Grant of License

A) Scope of License.

Subject to the terms of this EULA, Licensor hereby grants to Licensee a royalty-free, non-exclusive license to possess and to use a copy of the files.

B) Installation and Use.

Licensee can make back-up copies of the files. Licensee may install and use an unlimited number of copies of the files and make multiple back-up copies, solely for Licensee's business and personal use.

C) Reproduction and Distribution.

Copies of the files may be included with your own product, provided the files are not sold or included in a product or package that intends to receive benefits through the inclusion of the files.

2. Description of Rights and Limitations

A) Limitations.

Licensee and third parties may not reverse engineer, decompile, or disassemble the files, except and only to the extent that such activity is expressly permitted by applicable law.

B) Update and Maintenance.

Not applicable.

3. Title to Files

Licensor represents and warrants that it has the legal right to enter into and perform its obligations under this EULA, and that Licensee's use of the files, in accordance with the terms of this EULA, will not infringe upon the intellectual property rights of any third parties.

4. Intellectual Property

All now known or hereafter known tangible and intangible rights, title, interest, copyrights, and moral rights in and to the files, including but not limited to all images, photographs, animations, video, audio, music, text, data, computer code, algorithms, and information, are owned by Licensor. The files are protected by all applicable copyright laws and international treaties.

5. Support

Licensor has NO obligation to provide support services for the files.

6. Duration

This EULA is perpetual.

A) Automatically terminated or suspended if Licensee fails to comply with any of the terms and conditions set forth in this EULA; or

B) Terminated or suspended by Licensor, with or without cause.

In the event this EULA is terminated, Licensee must cease use of the files and destroy all copies.

7. Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of the European Union, without regard to conflicts of laws provisions. Any legal action relating to this EULA shall be brought exclusively in courts located within the European Union, and each party consents to such jurisdiction. The prevailing party in any action shall be entitled to recover costs and expenses, including attorney’s fees.

8. Non-Transferable

This EULA is not assignable or transferable by Licensee without the prior written consent of Licensor, and any attempt to do so shall be void.

9. Severability

No failure or delay by either party to exercise any right under this EULA will operate as a waiver. If any provision is deemed unenforceable, it shall be limited to the minimum extent necessary so that the rest of the EULA remains in full force.

10. Warranty Disclaimer

Licensor expressly disclaims any warranty for the files. The files are provided “as is,” without warranty of any kind, express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Limitation of Liability

Licensor shall not be liable for any loss of profits, savings, or other damages, whether direct or indirect, arising out of the use or inability to use the files. Under no circumstances shall Licensor’s liability exceed the amount paid by Licensee for the files.

12. Entire Agreement

This EULA constitutes the entire agreement between Licensor and Licensee, superseding all prior agreements.
